The shipping company covered all of Xiaopan’s medical expenses during his hospitalization but refused to pay additional compensation, arguing that there were designated dormitories on board and that Xiaopan violated company rules by sleeping on the deck. They claimed that since other crew members were resting in their cabins, Xiaopan’s actions should not qualify as a work-related injury. However, the labor department did not recognize the injury as work-related, leading Xiaopan and his family to file an administrative lawsuit in Wanzhou District Court. During the trial, the shipping company argued that Xiaopan was not injured during working hours and therefore should not be considered as having suffered a work-related injury. The court examined the three essential elements required for a work injury: workplace, working hours, and work-related reasons. It concluded that the entire ship was considered the workplace for the crew, and given the nature of their job, they were always on duty. Sleep time, especially for night shifts, was considered part of their working condition. Despite Xiaopan’s violation of company regulations by sleeping on the deck, the court determined that this did not disqualify his injury from being recognized as work-related under the Work Injury Insurance Regulations. The court ruled that the labor department’s decision not to classify the injury as work-related was invalid and ordered a new review. The shipping company appealed the decision, but both higher courts upheld the original ruling. This case highlighted the complexity of determining work-related injuries, particularly for those in special professions like seafarers. Legal experts emphasized that while sleeping may seem unrelated to work, the nature of a ship's operation requires crew members to be available at all times. According to the "Regulations on Work Injury Insurance," if an employee is injured due to work-related reasons during working hours and within the workplace, it should be considered a work injury.
